Terms and Conditions
These terms govern your access to and use of Cally. By creating an account or using the platform, you agree to these terms and our Privacy Policy.

1. Agreement and eligibility
You must have legal capacity to enter into this agreement and, when acting for a company, authority to bind that company. Information supplied during registration must be accurate and kept current.
2. The Cally service
Cally provides tools for configuring and operating AI-powered voice agents, campaigns, call workflows, integrations, transcripts, summaries, and related automation. Features may change as the service evolves.
3. Accounts and security
You are responsible for safeguarding credentials, controlling access to your workspace, and promptly notifying us of suspected unauthorized use. You are responsible for activity performed through your account except where caused by Cally's breach of its obligations.
4. Customer data and instructions
You retain rights in data you submit to Cally. You grant us the limited rights needed to host, transmit, transform, and process that data to provide and secure the service. You are responsible for the lawfulness, accuracy, and source of your data and instructions.
5. Calling, consent, and recording
You must comply with applicable telecommunications, marketing, privacy, consumer-protection, do-not-call, recording, and AI-disclosure requirements. You must obtain all necessary permissions before uploading contacts, initiating calls, recording conversations, or sending follow-ups. You must honor opt-outs and suppression requests promptly.
6. Acceptable use
You may not use Cally for unlawful, deceptive, abusive, discriminatory, harassing, or fraudulent activity; emergency calling; impersonation without authorization; unsolicited communications prohibited by law; collection of highly sensitive data without authorization; security interference; or attempts to reverse engineer or misuse the service.
7. AI-generated output
Voice responses, transcripts, classifications, summaries, and recommendations are generated automatically and may be incomplete or inaccurate. You are responsible for reviewing material outputs and must not rely on them as legal, medical, financial, or other professional advice or as the sole basis for high-impact decisions.
8. Trials, fees, and usage
Trial access may be limited by duration, minutes, features, or capacity. Paid subscriptions, usage charges, taxes, renewals, and cancellation terms will be shown in the applicable order form or checkout flow. You authorize applicable charges using your selected payment method.
9. Third-party services
Integrations, telephony carriers, AI providers, and other third-party services may have separate terms and availability. Cally is not responsible for third-party services outside our control, though we will operate our integrations with reasonable care.
10. Intellectual property
Cally and its licensors retain all rights in the platform, software, branding, documentation, and service improvements. Except for the limited right to use the service under these terms, no rights are transferred to you.
11. Availability and changes
We aim to provide a reliable service but do not promise uninterrupted or error-free operation. Maintenance, provider failures, network conditions, regulatory requirements, or security events may affect availability. We may modify or discontinue features with reasonable notice where practicable.
12. Suspension and termination
We may restrict or suspend access to address security risks, unlawful activity, non-payment, material breach, or harm to the service or others. You may stop using the service and cancel according to your plan. Provisions that should reasonably survive termination will remain effective.
13. Disclaimers and liability
To the maximum extent permitted by applicable law, the service is provided on an “as available” basis. Cally does not guarantee campaign results, call outcomes, regulatory compliance, or the accuracy of AI output. Liability limitations and any service commitments in an executed order form will control where they conflict with these online terms.
14. Governing terms and contact
An executed order form may specify governing law, venue, and additional commercial terms. Otherwise, applicable governing law will be determined by the contracting Cally entity and mandatory local law. Questions about these terms can be submitted through our Contact Us section.
